Education law states that parents do not have a right to take their child out of school for a holiday during term time. Only in exceptional circumstances may a Head Teacher grant permission for leave; and it is the Head Teachers decision on whether the absence is exceptional and how many days to approve.
Any unauthorised absence of 10 sessions or more in the last 10 school weeks will be issued with a Penalty Notice. The current fine is £80 for each parent for each child
(eg two parents with 2 children, 4 seperate fines will be issued).
If each £80 fine is not paid with in 21 days the amount increases to £160.
If a second penalty notice issued to the same parent for the same child within a rolling 3-year period will be charged at a higher rate of £160
On the third period of absence within a rolling 3-year period as penalty notice will not be issued and the parent will be refered to the Hampshire Legal Team for legal action to be taken.
Also, if any payments are not made within the timescales provided, the local authority will consider commencing proceedings in the Magistrates’ Court
